Collaborative divorce was first introduced in 1990 as a means to reduce the arguments and disagreements that arise because of traditional divorces. Lawyers work with the spouses in order to advise and represent their needs through the collaborative divorce process, but agree not to litigate any future family-law needs.

The collaborative divorce is built around adherence to a participation agreement, which both spouses sign. The agreement usually states:
