What is a contested/uncontested divorce?
A contested divorce means the parties disagree over issues such as property distribution, child custody, child support, etc., and will argue over them in court. An uncontested divorce, as the name implies, is the exact opposite – there are no disagreements over the above issues . If these issues have already been resolved by the parties beforehand, they may provide the court with a marital settlement agreement when they file for divorce. If the agreement is reasonable, it will become part of the divorce decree.
