Laura Dern seeks primary custody and spousal support in divorce

Posted on July 12th, 2012 No Comments

On Friday, actress Laura Dern filed for divorce from her 42-year-old husband, Ben Harper. This is the second time someone has filed for divorce in this relationship, with Harper originally filing the paperwork back in 2010.

Dern, 45, is asking for primary custody of the couple’s two children, as well as child and spousal support. When Harper filed the original documents, he wanted Dern to receive no spousal support from him in their arrangement, and he also sought joint custody of their children.

The couple attempted to save their marriage after Harper filed the paperwork, but apparently those efforts were futile. The couple dated for five years before marrying in 2005. They are the parents of a 10-year-old son, and a 7-year-old daughter.

The couple, commonly referred to as ‘TomKat’ by the media, was married in 2006. They have a 6-year-old daughter together named Suri. Katie, 33, is currently living in New York with her daughter in an apartment she has been renting for the past few months. Cruise is on location in Iceland filming an upcoming movie, and that is where he learned of the divorce.

Divorce becoming more common for couples over 50

Posted on June 25th, 2012 No Comments

In 1990, only one couple out of every 10 that went through a divorce was over the age of 50. Twenty years later, approximately four divorces for every 10 involved people who were older than 50.

Data from a federal government survey was compiled and utilized in this study by researchers at Bowling Green State University. The data found that individuals who were categorized as baby boomers were more inclined to divorce later in life. The demographics of this data showed that black couples were more likely to divorce after the age of 50 than white or Hispanic couples.

Several different trends have been attributed to this large increase, including the longevity of life spans in the United States, and the changing concepts behind marriage. The baby boomers are looking to obtain more out of life, and they are willing to go through a divorce in order to achieve happiness.

David Arquette not seeking spousal support in divorce

Posted on June 18th, 2012 No Comments

In October 2010, David Arquette and Courteney Cox announced their separation to the media. The couple, who married in 1999, has remained close throughout their two-year separation, and continue to raise their daughter together.

On Friday, David Arquette filed his divorce petition just minutes before Courteney Cox did the same. Arquette’s papers claim that irreconcilable differences were the reason for their divorce request. He has not sought the help of a divorce attorney, nor has he sought spousal support from Cox.

Cox, who is worth a considerable amount more than Arquette, has asked for joint custody, both physical and legal, of their 8-year-old daughter, Coco. The alleged lack of a prenuptial agreement may cause the couple to split their earned income during their marriage straight down the middle.

Facebook comes up quite frequently in divorce process

Posted on June 11th, 2012 No Comments

Facebook is a social networking site that helps bring people and ideas together, but it can also be used to tear people apart. In 2011, one third of all divorce filings that took place in the United States included Facebook as a reason for separation.

Individuals use evidence that they gather from this site to prove that a spouse was cheating, being unfaithful, or even acting as a poor parent. Child custody cases now involve information gained from the social site.

In three years time, the amount of divorce cases that involved Facebook rose by more than 10 percent, from 20 percent to more than 30 percent. Divorce attorneys that were surveyed also believe that the use of social networking in divorce cases will continue to increase, due to it’s popularity.

Rodman found guilty for failing to pay child support

Posted on June 5th, 2012 No Comments

Dennis Rodman, the eclectic former professional basketball player, has been found guilty for contempt after he failed to pay a large amount of child support to his ex-wife.

The 51-year-old reportedly owed $860,376 to the mother of his two children in the form of spousal support and child support. He had until a certain date in March to pay that whole amount, or he would be found in contempt of court. He did not make the payments, and therefore has been found guilty of contempt.

Rodman was sentenced to 104 hours of community service, and three years of probation. He will now have to pay all of the support that he owes, both current and past. His next court appearance is at the end of June, and he will continue to learn the depth of his contempt charge.

‘Pregnant man’ granted temporary custody of children

Posted on May 29th, 2012 No Comments

‘Pregnant man’ Thomas Beatie has won temporary custody of his three children while he goes through divorce proceedings with his wife.

Beatie earned the title of ‘pregnant man’ after he announced in 2008 that he was pregnant with his first child. The transgendered male has undergone several gender reassignment surgeries, but, up until recently, had kept his female reproductive organs in place in order to bear children.

He gave birth to three children between 2008 and 2010 through the use of artificial insemination. Beatie recently announced the troubled state of his marriage, and at the same time, he revealed he had completed his final reassignment surgery.

Divorce paperwork was filed shortly after the separation rumors were confirmed, and Beatie stated that his former wife was abusive, and he wanted full custody of his children. A judge in their case temporarily granted him that custody, after issuing a restraining order against his ex-wife.

Disability payments as part of spousal support under review

Posted on May 21st, 2012 No Comments

A man in Virginia is trying to have his alimony payments adjusted by the U.S. Supreme Court. The 42-year-old former veteran of the Air Force wants the court to make an official ruling declaring that divorce courts are unable to utilize disability benefits when calculating alimony and spousal support payments.

The man was declared disabled by the state of Virginia after he developed post-traumatic stress disorder from working as a first responder at the Oklahoma City bombing site in 1995. As a result of this hardship, he was unable to return to work and began collecting disability benefits as well as unemployment from the state.

Each month, the man earns $4,400 in disability payments, and he has been ordered to pay $1,000 out of that amount to his ex-wife. The couple was married for almost 20 years, and in 2010 they officially filed for divorce. The veteran does not believe that his former wife should be receiving any of his disability payments in the form of alimony, and therefore he has been fighting the ruling.

If you want your alimony payments to be adjusted, please contact the alimony modification lawyers of KennonLegal Ltd. LLP by calling 512-931-3726 today.

Spousal support sought by Mena Suvari’s ex-husband

Posted on May 14th, 2012 No Comments

Actress Mena Suvari is in the process of ending her second marriage. Suvari was married to concert promoter Simone Sestito for just 18 months.

While their separation and divorce proceedings are under way, Sestito is seeking a large amount of spousal support from his famous former spouse. He is looking to earn roughly $17,000 per month from his ex-wife, claiming that he was comfortable with a certain lifestyle and that he needs to maintain it.

The concert promoter has also filed documents stating that he is in a great deal of debt and is relying on spousal support from Suvari in order to stay afloat. He is also asking that Suvari cover his lawyer fees, which will roughly add up to $10,000. A judge has yet to make a ruling on this issue.

Usher dealing with child custody troubles

Posted on May 7th, 2012 No Comments

Usher currently has joint custody of his two young sons, but his ex-wife is looking to change that. She is asking the court for full custody of their 4-year-old and 3-year-old sons, claiming that Usher uses drugs around the children and is behind on his child support payments.

The singer’s former wife, Tameka, reported that he owes her $34,000 in child support and that he should actually be providing her with larger payments each month due to his change in income. The couple was married in 2007 and divorced two years later in 2009. Tameka filed the claim seeking full custody of their sons last year.

Usher has denied the harsh allegations against him and wants more time with his children. A judge in their case gave them a timeline to agree on a temporary arrangement. If unable to do so, the court will determine how much time each parent receives with the children.

If you are in need of assistance in regards to a child custody situation, please contact the Austin child custody attorneys of KennonLegal Ltd. LLP by calling 512-931-3726 today.
