Summary and Uncontested Divorce

Divorce can be a difficult time in anyone’s life. During this time, there are many emotions that go through both parties. This can make the divorce difficult in many cases. It is important to remember, however, that you have options even when you go through something like divorce.

There are several different types of divorce. If you are considering getting a divorce, you should choose the one that best suits your needs and situation. This will make the process of the divorce go far more smoothly.

Of the several different types of divorce, there are two types known as summary divorce and uncontested divorce. Summary divorce is used with certain eligibility requirements, or if the spouses can agree on some key issues before filing.

The key issues involved in a summary divorce include:

  • Having a short marriage
  • Not having children
  • Minimal property and no mortgage
  • Marital property does not exceed a jurisdictionally defined threshold
  • Each party’s personal property does not exceed a jurisdictionally defined threshold

Uncontested divorce is used when both parties can come to an agreement on property, children, and support issues. Uncontested divorces are estimated to make up over 95% of divorces in the United States. Once an equitable agreement is reached, the couple files for divorce and is almost guaranteed approval.
