Residency Requirements for Divorce

Texas Residency Requirements

Texas has very specific residency requirements for couples who are seeking divorce. According to state law, you or your spouse must have been living within Texas for six months before you can file for divorce. Also, you must have lived within your current county for 90 days. Once your divorce has been filed, Texas law requires that a couple wait 60 days before the divorce is made official.

If You Don’t Qualify as a Texas Resident

If neither you nor your spouse has been living in Texas for the requisite 6 month period or within one county for 90 days, there are a number of options available to you. If you want a divorce immediately, you may want to consider seeking divorce in the state in which you and your spouse previously lived. If this isn’t possible for you, however, you may have to wait until the required time has passed so that you can divorce in Texas. You and your spouse could continue to live together until you can pursue divorce, or you could consider separating.
