for you, and this will qualify as having your spouse served. After 60 days, you will go to court on
your scheduled date. If your spouse does not provide an answer within those 60 days and does not show
for the hearing, your divorce will be finalized according to your wishes.
When children are involved in the marriage, a more direct form of communication must be used to try
to track down the missing spouse. Texas law requires that you serve your spouse via publication, meaning
that you will list an ad in the local newspaper where your spouse was last known to live or where he
or she is expected to be living. The ad will state that you are seeking divorce from him or her. Unless
your spouse responds to the ad or shows up to the hearing on your scheduled court date, you will be
granted a missing spouse divorce.
