Unlike other restraining orders, these protective orders are issued directly from the soldier’s commander. Although a person may work through the Family Advocacy Program to persuade a commander to issue a protective order, these legal actions nevertheless remain fully in the rights and powers of the military commander to issue. If secured, a military protective order can offer the following protections:
- Requiring the abuser to move into barracks
- Abuser must stay away from the victim
- Abuser must attend counseling
- Abuser must relinquish their government weapons custody card
These benefits are temporary, but may facilitate further protection and punitive action on behalf of the relevant military branch. If a person violates a military protective order, severe punishment may be handed down by both military and criminal courts.
