The Differences between Legal Separation and Divorce

When you get a divorce, the process includes determining child custody and child support, determining spousal support, and dividing assets and debts. In addition, you will no longer be legally married to your spouse.

Legal separation is very similar to divorce in that you still have to determine child custody, child support, spousal support, and the division of assets and debts. The main difference is that your marriage is not over when you are legally separated. A separation agreement is much like a divorce settlement, but you retain marriage benefits.
