Emergency Protective Order
When something goes wrong, it always seems to be after-hours. You get sick you have to be rushed to the after-hour’s emergency clinic. If you need your car towed, it is always night. If there is someone in your life who continually threatens you, emotionally or physically, it probably happens when the court is closed. However, in this last instance, getting a restraining order in off hours is important and therefore the justice system has made it possible to get an Emergency Protective Order against the offending person in your life.
An Emergency Protective Order requires two things:
- A report from the police officers to respond to your call
- Proper filing for paper work for the emergency protective order
There are a few important steps you can take to better prepare yourself for review when getting the Emergency Protective Order, which will make it easier to get a permanent restraining order later if you wish it.
After calling the police and getting the incident reported, you should go immediately to some kind of health care center. Get any injuries reported and documented, including photos of the injuries. After you fill out some paper work, the police can contact a local judge, at any time, and get their permission to enforce an Emergency Protective Order. They will then give it to the offender and it will be valid for up to four days.
