Mediation is one of the most popular forms of divorce in the United States. This is very likely because of the way that the process works. Mediation is not actually a divorce process. Instead, you and your spouse work together to settle every aspect of the divorce before the legal proceedings.
When you go through the mediation process, you have a mediator. This person works for neither party and does not try to offer any solutions. Instead, your mediator keeps you on track throughout the process and allows you to come to your own conclusions and decisions. In addition, the mediator gives both parties the same information so that you can work things out fairly.
Working through your divorce with mediation generally means that each party is being treated fairly. For this reason, courts will often grant the divorce based on the agreement drawn up in mediation. This is a much quicker and easier way for the court to handle a divorce.
It is important to remember, however, that mediation does not work for everyone. Either party can decide to stop mediation at any point during the process. If this happens, the mediator cannot represent either party in the divorce proceedings. In addition, the information gathered in mediation cannot be used against the other party during the divorce.
